Ladywash Farm Holiday Cottage Booking Terms & Conditions
1.0 DEFINITIONS
1.1 “Owner(s)” refers to Ladywash Farm Ltd, Eyam, Derbyshire
1.2 “You” or “Your” refers to the person(s) making the Booking (“the Guest”).
1.3 “Property” refers to the accommodation let under this agreement.
1.4 “Booking” refers to the confirmed reservation made by You with the Owner(s).
1.5 “Rental Period” refers to the dates of occupancy specified in the Booking Confirmation.
1.6 “Security Deposit” refers to the refundable sum paid under clause 8.0.
1.7 “Terms” means these Terms and Conditions of Booking.
2.0 FORMATION OF CONTRACT
2.1 A binding contract shall exist between You and the Owner(s) once a completed Booking Form and Booking Deposit have been received and accepted.
2.2 The person making the Booking must be over 21 years of age and is responsible for all members of the party.
3.0 PAYMENT
3.1 A Booking Deposit of 30% of the total Rental cost is payable at the time of Booking.
3.2 The balance must be paid no later than 8 weeks (56 days) before the start of the Rental Period.
3.3 If the Booking is made within 8 weeks of arrival, full payment is due immediately.
3.4 Failure to pay the balance may result in cancellation of the Booking (see clause 4.0).
4.0 CANCELLATION
4.1 The Owner(s) reserve the right to cancel Your Booking if full payment is not received at least 8 weeks prior to arrival.
4.2 If You wish to cancel Your Booking, You must notify the Owner(s) in writing as soon as possible.
4.3 Cancellation charges:
- More than 8 weeks: Loss of Booking Deposit (30%)
- 8 weeks or less: 100% of total cost
4.4 If the Property is re-let, a refund (less £150 admin fee) will be made within 7 days.
4.5 Guests are advised to obtain comprehensive cancellation insurance (see clause 6.0).
5.0 OWNER(S)’ RIGHT TO CANCEL
5.1 If the Property becomes unavailable due to circumstances beyond the Owner(s)’ control, the Owner(s) may cancel by written notice.
5.2 All monies paid will be refunded in full. The Owner(s)’ liability is limited to such refund.
6.0 TRAVEL INSURANCE
6.1 Guests are responsible for obtaining adequate travel insurance covering cancellations and unforeseen circumstances.
6.2 If You choose not to insure, You accept responsibility for any resulting loss.
7.0 CHANGES TO BOOKING OR TERMS
7.1 The Owner(s) may revise these Terms at any time.
7.2 If changes materially affect Your Booking, You may cancel and receive a full refund.
8.0 SECURITY DEPOSIT
8.1 A refundable Security Deposit is required to cover damage or additional cleaning.
8.2 Deductions may be made for
- Damage or excessive cleaning
- Breach of Terms
- Unauthorised Guests or pets
8.3 Damage must be reported immediately.
8.4 Refunds (if applicable) will be made within 7 business days.
8.5 If deductions are necessary, notice will be given within 7 days.
8.6 You remain liable for costs exceeding the Security Deposit.
8.7 Serious damage rendering the Property uninhabitable may result in full indemnification.
9.0 PRIVACY POLICY
9.1 The Owner(s) respect Your privacy and will use personal data solely for Booking management purposes, except as required by law.
10.0 ADVERTISING AND ACCURACY
10.1 Information is provided in good faith but may differ slightly from the Property.
10.2 The Owner(s) are not responsible for minor discrepancies or local changes beyond control.
10.3 If a facility is important, confirm before Booking.
10.4 Wi-Fi or other services may occasionally be unavailable (see clause 16.0).
11.0 RENTAL PERIOD AND TIMES
11.1 Check-in and check-out times are as stated in Your Booking Confirmation.
11.2 Late departure without agreement may incur a charge.
12.0 NO SMOKING POLICY
12.1 Smoking and vaping is strictly prohibited inside the Property.
12.2 Breach may result in deductions for cleaning and deodorising.
13.0 NOISE POLICY
13.1 No loud noise is permitted outdoors after 10:00 p.m.
13.2 Restrictions:
- No outdoor speakers or fireworks
- No hot tubs, marquees, or amplified entertainment
13.3 Guests must be considerate of neighbours.
13.4 Serious breach may lead to eviction without refund.
14.0 PET POLICY
14.1 Pets require prior written consent.
14.2 Up to two well-behaved dogs may be permitted.
14.3 Dogs must be kept off soft furnishings and are not permitted in bedrooms.
14.4 Dogs must be kept under control and on a lead at all times.
14.5 You must supply their own Dog basket.
14.6 Pets must be parasite free.
14.7 Additional cleaning may be charged if necessary.
15.0 HEALTH AND SAFETY
15.1 The Owner(s) take reasonable steps to ensure safety
15.2 Guests must exercise due care and comply with guidance provided.
16.0 INTERNET AND WI-FI USE
16.1 Wi-Fi availability and speed cannot be guaranteed.
16.2 Guests must not use the service unlawfully or to access offensive material.
16.3 The Owner(s) may suspend service in case of misuse.
17.0 USE OF AMENITIES
17.1 Facilities must be used responsibly and in accordance with instructions.
17.2 Children must be supervised at all times.
18.0 RIGHT OF ENTRY AND EVICTION
18.1 The Owner(s) may enter without notice in emergencies or if Terms are breached.
18.2 Routine inspections will be notified in advance.
18.3 Repeated breaches may result in eviction without refund.
19.0 LOST PROPERTY
19.1 Lost property will be held for one month before disposal.
19.2 Return postage costs must be paid in advance.
20.0 EVENTS OUTSIDE OUR CONTROL
20.1 The Owner(s) are not liable for failures caused by events beyond their control, including natural disasters or power outages.
20.2 Guests should refer to clause 6.0 (Insurance).
11.0 COMPLAINTS
21.1 Complaints must be raised during Your stay to allow prompt resolution.
21.2 No compensation will be considered after departure if not raised earlier.
22.0 LIMITATION OF LIABILITY
22.1 Nothing limits liability for death or injury caused by negligence.
22.2 The Owner(s) are not responsible for unforeseeable losses.
22.3 Vehicles and belongings are left entirely at Guests’ risk.
23.0 SEVERANCE
23.1 If any provision is invalid, it shall be modified or removed without affecting the remainder.
23.2 Parties will act in good faith to replace invalid clauses.
24.0 GENERAL PROVISIONS
24.1 No variation is valid unless agreed in writing by both parties.
24.2 These Terms are governed by English law and subject to the jurisdiction of the courts of England and Wales.
